Italy — Tax for retirees
Updated
What this page covers
This page explains how Italy taxes retirees in plain words.
Tax resident means Italy treats you as living there for tax purposes. Italian tax residents pay tax on income from everywhere under IRPEF (Italy’s personal income tax), plus regional and municipal addizionali (extra local rates), unless a double tax treaty (DTT—an agreement between countries so you are not taxed twice on the same income) says otherwise, or you elect a special substitute regime.
Foreign pensions ordinarily enter the progressive IRPEF base.
Italy has a genuine pensioner preference: TUIR Art. 24-ter optional 7% substitute tax on foreign-source income for qualifying foreign-pension recipients who transfer residence to an eligible southern or seismic municipality. Separately, Art. 24-bis is an HNWI (high-net-worth individual) neo-resident regime—usually too costly for typical pension-only profiles. The lavoratori impatriati regime targets Italian-source work income and is usually irrelevant for pure pensioners.
Immigration status and tax residence are separate. Anagrafe (municipal population register) registration is a strong practical trigger but not the whole test.
This is not tax advice. Confirm your situation with a qualified advisor.
Who counts as a tax resident (simple)
Per Agenzia delle Entrate (Residenza fiscale, update 13 January 2026), you are an Italian tax resident for the majority of the tax year (≥ 183 days; 184 in leap years) if at least one of these is true:
- Habitual abode (dimora abituale) in Italy.
- Domicile as the place where personal and family relations principally develop.
- Physical presence in Italy, including fractions of a day.
- Registration in the Anagrafe della popolazione residente, unless you prove registration does not reflect actual residence.
Italian citizens who cancel Anagrafe registration and move to a listed privileged-tax jurisdiction remain presumed Italian residents unless they prove otherwise.
Domestic law is majority-of-year based. Some DTTs contain an express split-year clause. Absence of a treaty split-year clause does not create an automatic mid-year cut-off under Italian domestic law.
If you are from the EU
EU status does not replace the domestic days / Anagrafe / domicile tests.
For pensions from other EU/EEA/Swiss states, open the bilateral PDF on the Dipartimento delle Finanze DTT list. Agenzia’s EU pension guidance summarises OECD-style patterns:
- Private employment pensions often residence-only.
- Government/public service often source with nationality exceptions.
Some treaties with Finland, France, Germany, Luxembourg, Sweden allow dual taxation of social-security pensions—verify article text. Foreign tax credit: TUIR Art. 165 + the specific DTT.
Art. 24-ter eligibility depends on the qualifying foreign pension, prior non-residence, qualifying municipality, and administrative-cooperation relationship—not on EU nationality.
If you are from outside the EU (pensions)
Same domestic residence tests. Visa / residence permit ≠ tax residence, but you need lawful stay to settle.
Ordinary residents include foreign pensions in IRPEF. Indicative brackets (Agenzia; 2024 structure with 2026 Budget tweak):
- Up to €28,000 at 23%
- €28,001–€50,000 at 33% for 2026 (reduced from 35%; sterilisation notes for overall income > €200,000 per L. 199/2025)
- Over €50,000 at 43%
Confirm the current worksheet. Regional/municipal additions apply.
Non-residents receiving Italian-source pensions: generally taxable in Italy subject to DTT relief.
If you are from the USA
Treaty: US–Italy Convention signed 25 August 1999, in force for Italy 16 December 2009.
| Article (high level) | Typical outcome |
|---|---|
| Art. 18(1) — pensions for past employment | Taxable only in the residence State (subject to Art. 19(2)) |
| Art. 18(2) — social security / similar public payments | Taxable only in the residence State |
| Art. 19 — government service | Generally paying-State only, with residence+nationality exception |
| Art. 1(2) saving clause | US may tax citizens largely as if the Convention did not exist, subject to Art. 1(3) carve-outs |
Art. 23 relief (US foreign tax credit / Italian credit) is critical for US citizens resident in Italy. State taxes are not covered by the federal DTT.
Flag: IRA/401(k) characterisation; Form 8833; FBAR/FATCA; quadro RW. Whether a given US stream is “pensione di fonte estera” for 24-ter eligibility vs how it is taxed under Art. 18/19 is case-specific.
Special deals that may apply
Art. 24-ter TUIR — 7% for foreign pensioners (Mezzogiorno / seismic)
Optional 7% substitute tax (instead of IRPEF) on all categories of foreign-source income. Italian-source income stays under ordinary IRPEF.
Duration: Up to 10 tax periods (transfer year + nine following), per Circolare 21/E / Risposta 559. Agenzia’s citizen scheda still says “nove periodi” — read as the nine periods after the transfer year. Quote both formulations; do not invent a shorter cap.
Cumulative gates:
- Holder of foreign pension income (foreign payers—not Italian INPS as the qualifying pension).
- Transfer of Italian tax residence to an eligible municipality.
- Not Italian tax resident in the five tax periods before the first option year.
- Last residence in a jurisdiction with administrative cooperation with Italy.
- Municipality in Sicilia, Calabria, Sardegna, Campania, Basilicata, Abruzzo, Molise, Puglia, or listed seismic municipalities, with population ≤ 30,000 (from 7 April 2026 under Legge 34/2026 Art. 26; previously ≤ 20,000). Population = ISTAT figure at 1 January of the year before the first option year.
Elect in the income tax return for the year of transfer. Interaction with Art. 24-bis: do not stack casually.
Art. 24-bis — neo-resident HNWI
Flat substitute tax on foreign-source income: €300,000 per tax year for transfers from 1 January 2026 (Agenzia); transfers until 31 December 2025 were €200,000. Usually unsuitable for typical pension-only profiles.
Flag — family extension amount: Agenzia face still shows conflicting €25,000 vs €50,000 figures for family/extension amounts — leave as FLAG until Gazzetta / Budget 2026 confirms; do not hard-publish a single family figure.
Impatriati
50% inclusion on qualifying Italian-source work income—not a foreign-pension flat tax.
Things to double-check
- Exact list of eligible comuni after the 30k threshold (match ISTAT at the statutory reference date).
- 24-ter vs government pensions / US Social Security (eligibility vs treaty taxation).
- Interaction 24-ter ↔ 24-bis ↔ CFC / RW / IVIE-IVAFE.
- Mid-year moves without a treaty split-year clause.
- Neo-resident €300k (from 1 Jan 2026) — amending statute citation and grandfathering; family €25k vs €50k FLAG.
- Consulate / Anagrafe practice for non-EU retirees (varies by comune).
- Exact intermediate IRPEF worksheet figures after the 33% second-bracket change.
