Malta — Visas & long-stay residence for retirees
Updated
What this page covers
This page explains, in plain words, how retirees can live in Malta for the long term.
A visa is official permission to enter a country for a stated purpose. Residence means you are allowed to stay and live there beyond a short visit. Means of subsistence (also called “economic self-sufficiency” or “means”) means money you must show you have—so you can support yourself without needing Maltese social assistance.
EU means the European Union. EEA means the European Economic Area. Switzerland has similar free-movement rules. If you hold a passport from one of those places, free movement means registering with Identità (Malta’s identity and immigration agency) for an eResidence document when you stay longer than three months on a Treaty basis (including economic self-sufficiency). For retirees whose main income is a pension, the principal dedicated framework still in force for new applicants as of 2026-09-21 is the Malta Retirement Programme (MRP) special tax status under S.L. 123.134 (subsidiary legislation—detailed rules under the Income Tax Act), combined with Identità Form K (Economic Self Sufficiency) residence documentation.
Important: MRP is a tax-status programme administered via an Authorised Registered Mandatary (ARM—an authorised intermediary registered with the tax Commissioner)—not a “retirement visa” brand on Residency Malta’s homepage. Immigration carding is a separate Identità decision. Don’t mix MRP with the Nomad permit, MPRP (Malta Permanent Residence Programme—investment residence), or Identità’s narrow Form O “Pensioner” track for former local employees.
A 2027 reform (Individual Tax Programme, LN 195/2026) raises thresholds for new grants, with grandfathering for 2026 applications/grants. Retirely can help you compare localities once sequencing with the D-visa and Form K is clearer—optional, and separate from the visa itself.
This page is planning information, not certified legal or tax advice. Rules change. Always confirm with Identità, the Central Visa Unit, and your mandatary before you apply.
If you are from the EU/EEA/Switzerland
Identità states that EU citizens may reside in Malta for up to three months without a registration certificate. If stay exceeds three months, they must show they are exercising Treaty rights and have an obligation to apply for an eResidence Document. Treaty purposes include employment, study, family reunification, or being economically self-sufficient. EEA, British, and Swiss nationals enjoy some similar favourable conditions to EU nationals (Identità’s own wording—confirm current practice with Identità if you are British).12
An exact single-euro resource quantum for self-sufficient residence was not published on the Identità overview pages checked—follow Identità appointment checklists / Free Movement Order S.L. 460.17.1
Register with Identità via EU Nationals booking / Expatriates Portal. Typical themes: passport/national ID, proof of Treaty basis, accommodation, and health cover as required for the chosen basis.2
Work rights: EU nationals exercising free movement for employment generally access the labour market under EU rules (subject to regulated-profession recognition).1
If you are from outside the EU (main retiree route)
Official name and legal basis
| Layer | Official name / basis |
|---|---|
| Tax status | Malta Retirement Programme — S.L. 123.134 (Malta Retirement Programme Rules), under the Income Tax Act Cap. 123 |
| Residence documentation | Identità Form K — Economic Self Sufficiency (covers persons under MPRP, GRP, Malta Retirement Programme, and other schemes in force at application time) |
| Interaction | Becoming a permanent resident or long-term resident of Malta causes cessation of MRP special tax status (rule 6)3 |
MRP is open to EU/EEA/Swiss and third-country nationals who meet the Rules (post-2020 amendments). Many EU pensioners still use it for the tax treatment; immigration paperwork still runs through Form K when that is the chosen residence basis.
2027 reform (already enacted)
Legal Notice 195 of 2026 — Individual Tax Programme Rules, 2026 consolidates special tax categories including retired pensioner status. Status under ITP is granted for a five-year term, renewable (renewal admin fee €2,500). Grandfathering: any special tax status granted on or before 31 December 2026, including applications received up to that date, continues to apply until 31 December 2031. New applicants after that transition should check ITP retired pensioner thresholds (higher property and minimum-tax floors—see Other routes).4
Who it is for (MRP)
Per S.L. 123.134 (as amended, including L.N. 69 of 2020 opening to all nationalities):3
- Individual not in an employment relationship (may hold a non-executive board post in a Malta-resident company / public-character philanthropic activities—definition of “beneficiary”).
- In receipt of a pension (periodic; lump-sum commutation generally excluded), all of which is received in Malta, constituting at least 75% of chargeable income.
- Not a Maltese national; not domiciled in Malta and does not intend to establish domicile in Malta within five years of application; fit and proper; not a beneficiary under listed other special tax schemes.
Income / means and property floors (MRP)
| Requirement | Official figure |
|---|---|
| Pension share of chargeable income | ≥ 75%, all pension received in Malta |
| Minimum annual tax | €7,500 for the beneficiary + €500 per dependent and every special carer, per year of assessment |
| Tax rate on foreign income remitted to Malta (beneficiary, spouse, relevant children) | 15%, subject to the minimum above |
| Other chargeable income under the rules (where not at the 15% remittance rate) | Generally 35% |
| Administrative fee on application | €2,500 |
Qualifying property (S.L. 123.134 definitions):3
| Holding | Threshold |
|---|---|
| Qualifying owned property (typical post-1 July 2013 purchase in Malta) | €275,000 (Malta) / €220,000 (Gozo or South of Malta) — see Rules for older purchase variants |
| Qualifying rented property | €9,600 / year (Malta) / €8,750 / year (Gozo or South of Malta) |
Only the beneficiary, dependents, and qualifying household staff may reside in the qualifying property.
Residence-day conditions (cessation triggers, rule 6): must not reside in Malta for less than 90 days a year averaged over any five-year period; must not stay in any other single jurisdiction for more than 183 days in a calendar year.3
Identità Form K does not itself republish a separate euro “means floor” beyond requiring the Commissioner for Revenue certificate that the applicant satisfies the applicable special-tax law.5
Health insurance and housing
S.L. 123.134 rule 4(f): sickness insurance in respect of all risks across the whole of the European Union normally covered for Maltese nationals, for the beneficiary and dependents. Failure to maintain it is a cessation ground. Form K checklist: copy of Comprehensive Health Insurance Policy.35
Form K also requires lease (landlord ID, Housing Authority rental registration approval under Cap. 604 where renting) or purchase evidence; Lease Agreement Attestation Form stamped by lawyer/notary/legal procurator.5
Work restrictions
MRP beneficiary: not in an employment relationship (non-executive board exception as above). Form K / economic self-sufficiency is a non-employment residence purpose. Do not conflate with Identità Form O “Pensioner” temporary permit for former local employees, or with the Nomad remote-work route.36
Application path (high level)
- Engage an Authorised Registered Mandatary registered with the Commissioner.
- Apply for MRP special tax status under S.L. 123.134 (fee €2,500); due diligence / fit-and-proper checks.
- On written determination of special tax status, apply in person in Malta for Identità Form K before authorisation of stay expires, with passport copy, proof of legal status, accommodation pack, CFR certificate (Commissioner for Revenue certificate), comprehensive health insurance, lease attestation, and the rest of the Form K list.5
- Biometrics / eResidence card issuance per Identità process.
- Ongoing: retain qualifying property, health cover, pension remittance and 75% test, presence rules, annual tax return / notifications via ARM.
Validity
- Tax status (MRP): continues while conditions are met; ceases on the grounds in rule 6 (property, nationality/domicile, pension remittance, insurance, permanent/LTR status, public interest, presence rules).3
- Identità residence card: Form K distinguishes first-time vs renewal packs; exact card validity length was not printed on the Form K PDF retrieved—confirm on the live Identità economic-self-sufficient page.5
- ITP (from 2027 new grants): special tax status term 5 years, renewable.4
Family
S.L. 123.134 “dependent” includes spouse or person in a stable durable relationship; unmarried minor children / adopted minors in custody and financially dependent; and certain seriously ill/disabled adult children who reside in the qualifying property. Extra minimum tax €500 per dependent / special carer.3
Other routes (brief)
| Route | Role for retirees |
|---|---|
| Global Residence Programme (GRP) — S.L. 123.148 | Non-EU financially independent special tax status (not pension-specific). Same property buy/rent bands as MRP text; minimum tax €15,000; admin fee €6,000 (with €5,500 variant when buying in South/Gozo per Rules). Residence via Form K.7 |
| MPRP — Residency Malta Agency | Investment-based permanent residence (admin fee €60,000; contribution €37,000; €7,500 per adult dependent excl. spouse; rent ≥ €14,000/yr or buy ≥ €375,000; capital assets ≥ €500,000 of which €150,000 financial, or ≥ €650,000 of which €75,000 financial; NGO donation €2,000; residence card fee €500/person for five years; health insurance). Not pension-specific.8 |
| Nomad Residence Permit | Remote-work route—not the principal non-work retiree path. |
| ITP retired pensioner status (new grants from 2027) | ITP text raises qualifying owned property to €700,000 (Malta) and qualifying rent to ≥ €14,000/year; minimum tax €15,000; application fee €8,500; 5-year renewable status. Confirm live S.L. text before quoting.4 |
| Identità Form O “Pensioner” | Narrow track for persons who were long-time employed residents awaiting Maltese state pension approval—not the inbound foreign-pensioner MRP path.6 |
If you are from the USA
- Confirm whether a Malta national (D) visa is required. Identità Visa FAQ: even visa-exempt nationals must apply for a D-visa before travelling if the intention is to stay more than 90 days. Visa-exempt nationals may stay 90 days in any 180-day period without a Schengen C visa for short visits.9
- D-visas are processed by Identità’s Central Visa Unit (FAQ: not by applying “with a Maltese Embassy” as the decision-maker). Applications use Identità’s Extended service / VFS where available; process may take around 8 weeks from the VFS appointment.9
- For MRP / economic self-sufficiency: obtain special tax determination via ARM, then file Form K in person in Malta with CFR certificate, insurance, and housing pack while holding valid authorisation of stay.53
Common pitfalls: documents not in English or Maltese; translations not apostilled where required; missing Housing Authority rental registration / lease attestation; missing CFR certificate; health insurance not meeting “all risks across the whole of the EU normally covered for Maltese nationals”; relying on short-stay exemption for a planned >90-day residence.593
VERIFY / lawyer: Sequencing of D-visa, special-tax determination, and Form K for US applicants is case-specific—confirm with Central Visa Unit / Expatriates Unit and your mandatary before you book travel.
Simple checklist
- Separate CFR/MTCA special tax status from Identità Form K residence approval in your planning.
- Check whether you file under MRP (2026) or must use ITP thresholds (2027+); note grandfathering to 31 Dec 2031 for grants/applications by 31 Dec 2026.
- Confirm pension ≥ 75% remitted in Malta; budget minimum tax €7,500 (+ €500 per dependent) and €2,500 application fee under MRP.
- Secure qualifying owned or rented property at statutory thresholds; arrange EU-wide comprehensive sickness insurance.
- If US / visa-exempt intending >90 days: obtain D-visa via Central Visa Unit / VFS before travel.
- Diary presence rules (90-day five-year average; no >183 days in another single jurisdiction).
- Soft tip: Retirely can help you compare localities once mandatary and Identità sequencing is clearer.
Things to double-check before you apply
- Form K card validity length (not stated on retrieved Form K PDF)—confirm with Identità.
- Sequencing of D-visa / Central Visa Unit with Form K for US applicants—lawyer / Unit confirmation.
- Confirm 2027 ITP thresholds and grandfathering wording on live legislation.mt before quoting to clients.
- Exact South of Malta geographic list for property discounts (statutory Schedules / Commissioner guidance).
- Keep CFR tax status separate from Identità residence in all product copy.
- Becoming permanent / long-term resident ends MRP special tax status—material planning risk; tax adviser needed.
